Due to the recent (and somewhat unexpected) popularity of my Constructed Image fine art prints, I am launching a new marketing campaign. These are “digital paintings” based on my acrylic work. I capture details from my paintings, upload them into the computer and use assorted filters and processes to prepare a unique archival Kodak C-41 print. From time to time I further paint the print, re-capture the image and re-run the processes initially used. Normally, such a print would be sold for $150.00.
Due to the digital nature of this work, it occurred to me that it would lend itself well to internet based sales and distribution. Provided that there is sufficient demand, I will make high resolution digital files available on a licensing basis to those persons who would like to acquire my work, but for whom cost, distance and opportunity to view pose difficulties.
Conditions for the release and use of my digital art:
My current price is USD$25.00. I reserve the right to review the fee at any time.
On receipt of a bank-certified cheque or postal money order I will release the desired file to the purchaser.
Please note that I am not selling the file but rather, licensing its use as would be the case with shareware. Think of this as “ShareArt.”
The purchaser, by dealing with me acknowledges my copyright.
The purchaser agrees to make no more than one copy of the file to be kept on a separate, removable, mass storage device.
The purchaser agrees not to sell, not reproduce for sale, nor barter my work to another party.

The purchaser may give the file as a gift provided that all copies of the file are given together with all prints, transparencies, etc. In other words, a gift is a gift. The purchaser may no longer possess the gifted art.
The purchaser agrees to make no more than one print or transparency and to display no more than one copy of the file on any computer system at any time. Any deviation from this policy will require the payment of additional fees.
The purchaser will, together with the fee, provide an email address with sufficient capacity to receive and hold a 4 to 6 megabyte file. Upon receipt and clearance of payment, the image file will be sent..
Any abrogation of these conditions will result in the immediate and irrevocable termination of this and any previous agreements. With evidence of copyright violation, legal action may be taken.
In the case of a loss due to “force majeure” (your house burns down taking your computer with it) this agreement will be terminated and held void. Exception: file corrupted upon receipt – another copy will be sent. Under other circumstances, I may send a replacement for a damaged file if you ask me nicely. If you sell or give away your computer, you are responsible to remove the file or files provided to you under this general license.
